Methods and apparatus for placing intradiscal devices

Abstract
An osteotomy of a portion of a vertebral endplate and/or vertebral body allows for easier insertion of a device (502) that fits tightly into a disc space. A different aspect of the invention resides in a mechanical device (506) to hold the osteotomized portion of the vertebra against the vertebral body after the intradiscal device is placed. The device may be removed after the pieces of vertebra heal and fuse together.

AMENDED CLAIMS
[Received by the International Bureau on 21 June 2004 (21.06.04)): claims 8-16 new (2 pages)] A method of placing an intradisca) device into an intradiscal space between upper and lower vertebral bodies, each body having a section on opposing sides of the imradiscal space, the method comprising the steps of: truncating or removing at least a portion of the section of one or both of the upper and lower vertebral bodies; inserting an intradisca! device into the intradisca] space; and reaitaching the truncated portion or attaching a bony substitute to the truπcared or removed section of the vertebra] body,
2. The method of claim 1 , further including the step of providing a device for securing the attached or reattached portion of vertebral body.
3. The method of claim 2, further including the step of removing the device after the attached or reattached portion fuses to the vertebral body.
4. The method of claim 2, wherein the truncated or removed portion includes a part of an annulus fibrαsis.
5. The method of claim 1, wherein the bony material is autograft or allograft.
6. The method of claim 1, wherein: a portion of both the upper and lower vertebral bodies are truncated or removed; and a da material is used between the attachments,
7. The method of claim 6, wherein the dam material is flexible,
8. The method of claim 7. further including the step of providing a plate which fastens to a vertebral body for holding the truncated portion or bony substitute in position once reattached.
9. The method of claim 1, further including the steps of:
AMENDED SHEET (ARTICLE 19} forming a hole in a vertebral body; and fastening a sleeve to a vertebral body using the hole to hold the truncated portion or bony substitute m position,
10. The method of claim 1, further including the steps of: removing a portion of an annulus fibrosis along with a section of one of the vertebral bodies; and providing a plate or other fastener Lo reattach the section to its respective vertebra] body.
11. The method of claim 1, wherein the bony substitute contains allograft bone,
12. The method of claim 1 , further including the steps of, installing a fastener into a vertebral body; and holding the truncated portion or bony substitute m position using the fastener.
13. The method of claim 12, further including a member coupled to the fastener for lightening the hold of the iruncated portion or bony substitute in position.
14. The method of claim I, further including a guide temporarily attachable to the a vertebral body for tmncaiiπg or removing at least a portion of the section of one or both of the upper and lower vertebral bodies.
15. The method of claim 14, wherein guide accepts an osteolome.
16. The method of claim 14, wherein guide is U-shaped.
