Abstract

Das Stillsetzen dieser rotierenden Umlaufkörper erfolgt bei jedem Spielvorgang jeweils nach unterschiedlichen Zeitabständen. Bei dem bekannten Münzspielgerät der Eingangs genannten Art ist ein Zufallsgenerator vorgesehen, mittels dessen die Umlaufzeit des Umlaufkörpers zufallsmäßig variiert werden soll. Münzspielgeräte dieses Typs sind als Unterhaltungsgeräte mit Gewinnmöglichkeit anzusehen, deren Zulassung nach den Vorschriften der §§ 33 C Gewerbeordnung in Verbindung mit § 11 der Verordnung über Spielgeräte und andere Spiele mit Gewinnmöglichkeit (Spielverordnung) erfolgt. Da bei einem solchen bekannten Gerät der Spielablauf zufällig erfolgt und nicht vorhersehbar ist, wann eine Symbolkombination auftritt, bei der ein Gewinn an den Spieler gegeben wird, geht die Rechtsprechung davon aus, daß zwischen dem Spieler und dem Automatenaufsteller ein Spielvertrag gemäß § 762 BGB geschlossen wird.
